Not every talent acquisition professional gets into the nitty-gritty of hiring compliance, but as the world of work continues to shift to a virtual setting, understanding what can land your organization in hot water with various government agencies is your ticket to success. For example:

  • The Department of Homeland Security’s (DHS) ongoing relaxation of Form I-9’s in-person inspection rules may signal permanent changes on the horizon in order to accommodate the workforce’s changing composition.
  • Various states are implementing equal pay and preemployment inquiry laws, and if you're hiring workers from these states, you must understand these laws.
    • For example, Colorado’s equal pay law requires all employers with at least one employee in the state to disclose compensation and benefits information in job postings for jobs that can be performed in Colorado.
    • Connecticut’s disclosure of wage range law requires employers to provide the wage range for a position when a job applicant requests it or before the applicant is made an offer of compensation.
  • Lawmakers continue to pass laws banning or limiting noncompete and no-hire agreements. Employers must stay current on the state-specific laws governing restrictive covenants and new federal activity.

Compliance Track | ADA and Long COVID-19: When Is Long COVID-19 an ADA Disability?

Equal Employment Opportunity Commission (EEOC) guidance says long COVID-19 may be an ADA disability if the symptoms substantially limit a major life activity. According to recent research, one in three people who get COVID-19 may have ongoing health problems, so employers will need to learn how to manage requests for accommodation based on long COVID-19.

As employers prepare for work post-pandemic, they will need to consider accommodations that weren’t available or weren’t in place before the pandemic. For example, an employer might not have had technological capabilities that would allow telework pre-pandemic but now has those in place. So, an accommodation that wasn’t reasonable pre-pandemic may now be reasonable (i.e., not an undue hardship).

Now that these accommodations are in place, another area of concern is determining which employee actually needs an accommodation or which worker is just using it as an excuse to continue remote working arrangements. In this session, our expert attorney will guide you through accommodating workers' requests in the new normal of long COVID and provide you with other guidance on how to stay compliant with the ADA.

For women, and especially women of color, the fight for equal pay has been going on for decades. And it seems like female workers are finally starting to make more headway—shout out to the Lilly Ledbetter Act. Across the nation, states and municipalities are creating laws designed to reduce the gender pay gap and instill equal pay.

For instance, some states prohibit salary history inquiries, while others take it a step further and also require pay range disclosure at different points in the hiring process, and many states now protect workers who discuss pay with their colleagues. As corporate social responsibility continues to be important to jobseekers, maybe it's time your organization took a second look at its pay practices.

In the very least, you'll want to stay on top of all these developments at the local level because these changes may one day become federal law. Or, your state could also follow in the footsteps of others like Colorado, Connecticut, and many more that have put equal pay or wage disclosure laws in place. And if you're a multistate employer, you will face challenges created by the differences in state/city laws governing pay transparency. If you aren't in compliance with these various laws, you could face a potential pay audit from the DOL.

This session is designed for all professionals in the talent acquisition space to better understand laws surrounding equal pay, pay transparency, salary ranges, and pay disclosure. At each stage of the employee life cycle, "pay" will come into play, so it’s better to prepare yourself now in case you need to have a difficult "pay" conversation down the road.

Jeremy Brenner

Jeremy Brenner is an experienced employment attorney and coleader of the firm’s national wage and hour/Fair Labor Standards Act (FLSA) practice. He has served as a strategic business partner to employers for over a dozen years, both as an HR consultant and as an employment attorney. He has been recognized as a Rising Star in Employment and Labor Law by Missouri/Kansas Super Lawyers® consecutively since 2014, and was named an Up & Coming Lawyer by Missouri Lawyers Weekly in 2017.

A substantial portion of Jeremy’s practice is devoted to wage and hour law. He has successfully handled many Department of Labor investigations around the country and litigated numerous misclassification, overtime, and minimum wage collective and class actions under the FLSA and other similar state laws. He has defended wage cases in state and federal courts across the country, including Missouri, Colorado, Florida, Tennessee, California, Arkansas, and Texas.

Abby Larimer

Abby Larimer, of Counsel at Ford Harrison, concentrates her legal practice on the representation and counsel of management in a broad range of matters related to employment law. Abby has represented employers in matters involving restrictive covenants, Title VII of the Civil Rights Act, the Americans with Disabilities Act (ADA), the Family Medical Leave Act (FMLA), and has significant experience counseling employers on issues stemming from regulations under the Fair Labor Standards Act (FLSA) and state wage and hour laws such as employee misclassification, meals and rest breaks, and other wage and hour concerns.

Abby also guides clients through internal investigations, terminations, and reductions-in-force, with an emphasis on utilizing best practices in these procedures in order to minimize legal risks and prevent litigation when possible. Policy review and revision is another component of Abby's preventive counsel practice, and she routinely works with employers to ensure that their personnel policies align with federal, state, and local employment laws.

Jonathan R. Mook, Esq., a partner with DiMuro Ginsberg, is a nationally recognized authority on the Americans with Disabilities Act and the author of two treatises published by Matthew Bender Company, “Americans with Disabilities Act: Employee Rights and Employer Obligations” and “Americans with Disabilities Act: Public Accommodations and Commercial Facilities.”

Jonathan lectures nationally on the ADA and other employment law topics. He represents employers and businesses on matters relating to employment law, business torts, and business disputes. Rick Morgan

Rick Morgan is certified by the South Carolina Supreme Court as a specialist in employment and labor law. He represents employers and has tried to verdict numerous employment defamation, discrimination, harassment and retaliation cases.

Rick advises and counsels employers on all aspects of employment and labor law issues and has experience representing employers in state and federal courts and in administrative tribunals. He has defended employers in litigation involving wage and hour laws, unemployment compensation, unfair labor practices, contract disputes, wrongful termination, negligent supervision/hiring/retention, intentional infliction of emotional distress, conspiracy and enforcement of non-compete agreements. In addition, Rick has advised employers during union organizing attempts and in OSHA matters. Rick sits as a part-time Municipal Judge for the City of Columbia.

Chris Murdock

Chris Murdock is a highly experienced veteran of the recruiting and talent acquisition industry. With more than 20 years of executive recruiting experience, he acts as cofounder and chief sourcing officer for IQTalent Partners. Prior to establishing IQTP as a talent acquisition leader, Chris gained in-depth experience working in the technology recruiting sphere for companies like Yahoo!, Heidrick & Struggles, and TMP Worldwide.

Teresa Shulda

Teresa Shulda, a partner in Foulston Siefkin’s Employment & Labor Practice Group, has been litigating workplace disputes and advising on employment law matters throughout her career. Much of Teresa’s practice includes advising clients on compliance-related issues and litigation-avoidance tactics. Working hand-in-hand with Human Resources departments, company owners, and in-house legal counsel, Teresa crafts strategies that meet the company’s goals and fulfill federal and state requirements. She also regularly defends employers against discrimination claims, including those involving age, race, religion, national origin, gender, disability, and FMLA allegations.

Justin Whitehead
