The nation has seen an alarming rise in gun-related violence in schools, churches, temples, theaters, concerts, and workplaces. With the rates of mass shootings on the rise, employers now grapple with ways to make their organizations secure and prevent unanticipated violence in the workplace.  To combat workplace gun violence, employers may enact various controls and provide trainings to all employees on how to respond to these incidents. 

In the wake of gun-related violence, numerous states have enacted laws known as “red flag” laws that enable judges to order the removal of firearms from people who are deemed a danger to themselves and others and allow employers to seek restraining orders to protect themselves and their employees from gun violence. Even in states that have not adopted red flag laws, private employers may take steps to implement workplace violence prevention programs that can protect from gun violence on the worksite. While employers can generally establish a no-weapons policy for the workplace, employers must be careful to avoid implementing overarching policies that could violate state and local laws.

For example, some states have laws that allow individuals with legal firearms to keep them in their vehicle in the parking lot at work.  Therefore, it is critical that employers know the laws in their state and local jurisdictions to determine how much or how little they can do to limit access to legal personal weapons as pertaining to the workplace.
