WEBINAR SNAPSHOT: In this webinar, you will receive an overview of employer obligations and employee rights created by the Families First Coronavirus Response Act, as well as examples of state law obligations and other considerations.


The current pandemic has resulted in new and unforeseen challenges for employers of all sizes and within all industries. The passage of the Families First Coronavirus Response Act (“FFCRA”) has created new compliance obligations for many employers, as well as associated legal risks. As plaintiffs begin to file lawsuits relating to alleged violations of the FMLA, the FFCRA and ADA in connection with COVID-19, it is critical that employers understand their obligations in order to help defend themselves, as well as to promote a healthy and productive workforce.

As more employers begin to open up, it is important that employers take appropriate steps to help protect employees and customers alike. This webinar will include a discussion of the use of a “test-based” and “symptom-based” strategy for testing for COVID-19 in the workplace.

Finally, in August 2020, the United States District Court for the Southern District of New York issued an opinion declaring invalid certain portions of the Department of Labor’s regulations implementing the FFCRA, including certain portions dealing with the use of intermittent leave. Subsequently, DOL issued revised regulations. Human Resources professionals should understand the impact of these developments.

At the conclusion of this program, participants will be able to:

  • Understand employer obligations and employee rights created by the Families First Coronavirus Response Act (“FFCRA”);
  • Be aware of recent developments and litigation surrounding COVID-19, including claims filed under the paid leave and expanded family medical leave requirements of the FFCRA.
  • Gain an understanding of the EEOC’s guidance relating to compliance with the ADA in the context of COVID-19, including issues relating to testing;
  • Understand employer obligations and best practices relating to testing for the virus; 
  • Gain an understanding of legislative efforts to create liability protection for employers with respect to claims arising from or relating to COVID-19;
  • Understand recent developments relating to the Department of Labor’s regulations implementing the FFCRA.
