On March 19, 2021, Governor Gavin Newsom signed California Senate Bill 95 (California Labor Code Section 248.2) into law, requiring employers to provide California employees with supplemental paid sick leave in connection with COVID-19.

More importantly, under certain circumstances it requires leave to be applied retroactively to January 1, 2021. This supplemental leave is in addition to leave provided under the California Healthy Workplaces, Healthy Families Act of 2014 (and interacts with several other paid leave laws), and the number of covered employers under the law is greatly increased.

 Attendees will also receive guidance on how to update their policies and practices in key areas, such as leaves of absence, wage and hour compliance, accommodations under supplemental paid sick leave, the Families First Coronavirus Response Act (FFCRA)/American Rescue Plan of 2021, the FMLA/CFRA, and more.

At the conclusion of this program, participants will be able to:

  • Determine which employers are covered under the supplemental paid sick leave law and other various leave laws,
  • Determine how the recent law on supplemental paid sick leave law impacts both in-state and out-of-state employers,
  • Update employer paid sick leave policies as necessary, particularly any policies that don’t follow the revised guidance on supplemental paid sick leave and/or the timing of notice documentation and notice for such leave,
  • Ensure that employees get the leave they are entitled to under the new supplemental paid sick leave law and other leave laws,
  • Establish when employees can use the different types of leave available to them, and
  • Do’s and don’ts for how employers should administer supplemental paid sick leave in light of other protected leave under the FFCRA/American Rescue Plan of 2021 and the FMLA/CFRA.
