In late 2009, the EPA issued its final rule on the mandatory reporting of greenhouse gases (GHG) – but there’s still confusion about the compliance requirements.

The largest emitters, who roughly contribute 85 percent of the total U.S. GHG emissions, are now required to collect data for final reporting to the EPA. This rule affects roughly 10,000 facilities throughout the United States. Additionally, new facilities are required to install Best Available Control Technology (BACT).

Failure to report, or incorrect reporting, may result in criminal penalties, injunctions, and civil and administrative penalties of up to $37,500 per day per violation.
