The Department of Homeland Security (DHS) defines an active shooter as an individual(s) actively engaged in killing or attempting to kill people in a confined and populated area. In a detailed study on active shooters released at the end of 2014, The FBI identified 160 active shooter incidents from 2000 to 2013. In the first seven years of the study, there was an average of 6.4 incidents per year. However, in the last seven years of the study, the average increased to 16.4 incidents annually, with an average of 11.4 incidents annually — but the trend is increasing each year. The incidents were also widespread, occurring in 40 states and the District of Columbia.

The DHS suggests that the best way to address potential active shooter scenarios is advance preparation and training. Developing a “Workplace Violence and Active Shooter Emergency Action Plan” and training employees on that plan are the critical elements for successfully protecting your workforce. Most organizations already have an Emergency Action Plan to address workplace emergencies such as fires, weather, earthquakes, and other potential life-threatening events. Taking that plan and adding procedures to address the specific challenges of active shooter scenarios is the best and most logical place to begin building your program. Many of the elements for each type of emergency will be the same.

Tracy L. Moon, Jr. is a partner in the Atlanta office of Fisher & Phillips LLP. He represents employers in all aspects of labor and employment law. His experience includes representation of employers before state and federal trial and appellate courts in matters under Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act, Americans With Disabilities Act, Family and Medical Leave Act, and a variety of state law wrongful discharge, contract and tort claims. Moon also represents of employers before the National Labor Relations Board and other government agencies, including the EEOC and OSHA. Moon counsels and trains employers on labor and employment law, including conducting on-site compliance inspections and in-house management training programs.
